T&Cs - The Cheltenham Ice Rink
The Cheltenham Ice Rink, Imperial Gardens
This ticket is issued on behalf of Cheltenham Borough Council as the Promoter and S3K Group Ltd as the Operator.
1. Admission to the ice rink is by ticket only. All skaters must have a ticket. All tickets are issued subject to the rules and regulations of the ice rink. All skaters and spectators agree to abide by the rules displayed on signage, and instructions given to them by rink staff.
2. If purchasing a special priced ticket which requires verification of ID or proof of eligibility, the ticket holder will be responsible for providing this when redeeming the ticket at the rink.
3. The Operator reserves the right to refuse admission to the ice rink and any area surrounding the ice rink. The Operator shall be entitled to conduct security searches to ensure the safety of all visitors.
4. The Operator reserves the right to remove anyone who is under the influence of drugs or alcohol, or who, in the reasonable opinion of the Management, is conducting themselves in an inappropriate manner. Anyone who has been removed from the ice rink for inappropriate behaviour will not be refunded.
5. Smoking (including the use of e-cigarettes) is prohibited within the ice rink and surrounding ice rink area. Eating, drinking and the use of photographic and recording equipment or mobile phones is also prohibited whilst ice skating. Those refusing to comply with requests from ice rink staff may be asked to leave the ice rink immediately.
6. Security and 24-hour CCTV cameras are in use across the event site including the ice rink and ice surface for safety, insurance and fraudulent claim purposes. All video images and audio, from all cameras are recorded, and kept for a minimum of 6 years.
7. Tickets must not be resold or transferred. Any tickets which have been resold, transferred, altered or defaced will be void.
8. Neither the Promoter nor the Operator will be responsible for any tickets which are lost or stolen.
9. Tickets are non-refundable. Subject to availability, and at the management’s discretion, if requested in writing to [email protected] at least 48 hours prior to the booked session start time, tickets may be transferred to another session of the equivalent value. It is the visitor’s responsibility to check their tickets as mistakes cannot always be rectified.
10. Purchases made by card online are subject to a non-refundable booking fee of £1.50 per transaction.
11. The ice rink is under the cover of a marquee. It will operate in all weathers unless the Operator identifies a health and safety risk. If ticket holders choose not to attend or leave early due to weather conditions, no refund, either in part or full, will be given.
12. In the unlikely event a session is cancelled or curtailed by the Operator, refunds (excluding booking fee) will only be given if cancellation or curtailment occurs after less than 30 minutes of skating time has taken place. If 30 minutes or more have passed, ticket holders will be offered an alternative session, subject to availability.
13. The Promoter reserves the right to close the ice rink and access to the surrounding area at short notice and without prior warning, where such closure is deemed necessary by the Promoter.
14. Each visitor is responsible for attending their session 15-30 minutes before the session time starts. The Operator is not obliged to refund the ticket or reallocate a new session time if the visitor arrives late and misses all, or part, of their session.
15. Admission to the rink is by ticket only. All participants must hold a ticket of the appropriate type and value to gain access to the ice rink. The Operator reserves the right to request ID and/or proof of booking.
16. Each skating session is 60 minutes long. Ticket holders will not be permitted to continue skating once their allocated session is over.
17. By entering the site, visitors consent to being photographed, filmed or recorded and consent to such photographs, films or recordings being used by the Promoter to publicise the event. Any visitors specifically wishing to be excluded from such promotional materials should make their presence known to staff before they skate, and preferably in writing to [email protected].
18. Participating in ice skating carries an inherent risk. All visitors that skate or enter the venue do so at their own risk. Anyone with previous injuries or medical conditions should carefully consider whether it is safe to participate without endangering themselves or other participants, and seek medical advice.
19. By purchasing a ticket, you hereby agree that the Promoter or the Operator are not liable for any damages to person or property (including injury and death) resulting from your participation in recreational public ice skating at our ice rink except where the damage or injury is as a direct result of negligence by the Promotor and/or the Operator. Except for death or injury to persons, the Promoter’s and/or the Operator’s liability to the purchaser is limited to the cost of the booking.
20. Lockers and shoe storage facilities are used at your own risk. The Operator accepts no responsibility for damage, loss or theft of any personal property that occurs whilst ticket holders are enjoying the ice rink.
21. The minimum age requirement for any visitor to use the ice rink is 3 years old. All 3 to 7 year olds must be accompanied onto the ice by an adult (someone 18 years old and above) in ice skates, with up to a maximum of five children per adult. The Operator reserves the right to refuse entry to the ice rink for any visitors who do not meet this age requirement. Please note, while a limited number of skate aids will be available to support and encourage young skaters, small children can sometimes be a little nervous skating for the first time. Please consider viewing the ice rink before purchasing a ticket for a small child as refunds will be not available.
22. The ice rink welcomes wheelchair and disabled users providing they are accompanied onto the ice by a carer. Personal Assistants are free of charge and tickets are not required. Proof of entitlement must be provided at the check-in point to the ice rink. Skate Marshalls will be onsite to support where necessary and ensure an enjoyable experience for all. However, their primary role is to maintain health and safety on the rink and they cannot dedicate their time to individuals.
23. The cost of skate hire (£3.50) is included in the ticket price. Visitors are permitted to bring their own skates but there is no reduction in price, and the Operator reserves the right to refuse access if the skates are deemed unsafe and in this instance, alternative stakes will be provided from the Skate Exchange.
24. Nothing in these Conditions confers or purports to confer any right to enforce any of its terms on any person who is not a party to it.
25. These Conditions shall be governed by and construed in accordance with English law and the Contractor hereby irrevocably submits to the jurisdiction of the English courts.
26. These Conditions constitutes the entire agreement and understanding between the parties and supersedes all prior written and oral representations, agreements or understandings between them relating to the subject matter.
27. The failure by any party to exercise any right or remedy shall not constitute a waiver of that right or remedy. No waiver shall be effective unless it is communicated to the other parties in writing. A waiver of any right or remedy arising from a breach of these Conditions shall not constitute a waiver of any right or remedy arising from any other breach of these Conditions.
28. If any Condition or provision of these Conditions is held to be unlawful, invalid or unenforceable by a court or tribunal, the validity or enforceability of the remainder of these Conditions shall not be affected.
29. The Promotor and/or the Operator may amend these Conditions from time to time and any changes will be posted on the Promotors and/or Operator website(s).
30. Neither the Promoter nor Operator shall be liable for any breach of Contract for any delays or failures in performance of the Contract which result from circumstances beyond the relevant party’s reasonable control.
